Job Description

Develop a Youth Position Paper on the Private Voluntary Organizations Amendment Bill: National Association of Youth Organisations (NAYO)

Purpose of assignment and objectives
The assignment of the consultant is to develop a Youth Position Paper on the Private Voluntary Organizations (PVO) Amendment Bill given its direct implications to the operations of Youth organizations in the country. The final draft Private Voluntary Organisations Amendment Bill was approved by the Cabinet at its meeting on Tuesday 31st August 2021 and the Government Gazetted the Bill on the 5th of November 2021. In a post-Cabinet briefing by the Minister of Information, Publicity and Broadcasting Services highlighting the approval of the Bill by the Cabinet gave the following summary on the Bill, which are summative of its intentions as:

Duties and Responsibilities

“The amendments seek to combat money laundering and financing of terrorism by any individual or institution in Zimbabwe operating under the Private Voluntary Organisations banner. The amendments also seek to streamline the administrative procedures for Private Voluntary Organisations in order to ensure their efficient registration, regulation and the combating of the financing of terrorism. The Registrar of PVOs is also being accorded powers to penalize non-compliant organizations. The PVO Amendment Bill was necessitated by growing regional and global concerns about money laundering and the financing of terrorist activities. It is now known that terrorist activities can be committed using seemingly authentic transactions, either as humanitarian aid or as development assistance. Since the current PVO Act was silent in this regard, the Bill seeks to close the loophole and ensure that all PVO activities are transparent and are conducted in the national interest. As a member of the International Financial Action Task Force, Zimbabwe is obligated to ensure compliance by all PVOs operating in the country, without exception. Whereas registration has all along been free, the Registrar is now empowered to collect registration fees from all PVOs. The Bill prohibits PVOs from political involvement, and requires them to discharge their mandate for the benefit of society’s most vulnerable. PVOs are therefore prohibited from undertaking political lobbying on behalf of any individual, organisation or political party, and the Bill stipulates penalties for those PVOs that violate the Act. The Registrar can also impose civil penalty orders on PVOs which break the law, with high risk PVOs being placed under monitoring. The Executive Committee of a PVO can be suspended for either maladministration or failure to discharge the declared mandate.”

NAYO thus seeks the services of a Consultant to develop a Youth Position Paper on the Amendment Bill which will guide Youth in engaging in Parliamentary processes and other advocacy actions related to the Bill.

Specific objectives include
To review the Private Voluntary Organizations (PVO) Amendment Bill provisions and their consistency to the Constitution of Zimbabwe provisions; To review the Private Voluntary Organizations (PVO) Amendment Bill provisions and their consistency to International and regional law and International and regional processes to which Zimbabwe is a signatory that relate to the operations of civil society organizations and or seek to regulate civic space; To analyze similar jurisdictions within African Countries, the legal frameworks which regulate the operations of Civil Society organizations (CSOs) with a view of harvesting good practice which can aid the proposed Amendments to the Private and Voluntary Organizations (PVO) Bill and for the provision of an enabling environment for civil society organizations to thrive across the different sectors in which they are active; To provide clear and objective policy positions / recommendations / key Ask’s for Youth on the Amendment Bill for the purposes of Youth lobby and advocacy in the roll out of various parliamentary processes before enactment of the Bill; Drafting a Youth Position Paper on the Private Voluntary Organizations (PVO) Amendment Bill and share with NAYO Secretariat for inputs before consolidation of the same.

Deliverables
A draft Youth Position Paper on the Private Voluntary Organizations (PVO) Amendment Bill.; Subjecting the draft paper to inputs from the NAYO Secretariat and provincial Structures under the Leave No Youth Behind to input key issues from respective provinces and validate the paper before finalization; To Consolidate the Youth Position Paper on the Private Voluntary Organizations (PVO) Amendment Bill; Submission of the proposed position paper on the Private Voluntary Organizations (PVO) Amendment Bill.

Qualifications and Experience

Qualifications and experience
The consultant should have a Masters’ Degree in Social Science, Political Science, Law, Gender Studies, Development or related fields; Minimum 3 years of relevant work experience on governance, Youth Policy Advocacy and Research; Proven working experience on Youth representation and participation issues.
